Welcome to A Borrowed Chef. By using A Borrowed Chef, you agree to the following Terms and Conditions. These Terms constitute a legally binding agreement governing your use of A Borrowed Chef and its services, specifically those related to placing and retrieving orders for food products on designated dates. Should you disagree with any provision of these Terms, you are prohibited from using A Borrowed Chef or its services.

USE OF A BORROWED CHEF

Users of A Borrowed Chef are prohibited from using A Borrowed Chef for purposes that violate these Terms. Disrupting or compromising the security, functionality, or integrity of A Borrowed Chef is prohibited. Falsifying identities or providing inaccurate information during account registration or order placement is also prohibited.​

ORDERS AND PAYMENTS

Any inaccuracies in the information you provide, including your full name, email address, phone number, and payment details, when you place an order, may result in delays or inability to fulfill your order.

When you successfully place an order, you will receive a confirmation email along with a confirmation SMS in alignment with the practices detailed in our Privacy Policy.

Payments are securely processed through Wix Payments. By submitting your payment details ,you authorize A Borrowed Chef to use Wix Payments to securely process the transaction for the stated amount. Please refer to Wix Payments’ Privacy Policy.

It is your responsibility to retrieve your order at the designated location and time stipulated in your confirmation. Failure to do so may result in the inability to fulfill your order.

USER ACCOUNTS

There are three ways you can create an account:

Email and password: users can use their email and create a password to create an account. Users can only have one account per email. User’s display name will be the user’s email address excluding the email address’s domain. User emails will be collected only as a form of identification to use to register and sign in to accounts.

Google: users can use a Google account to create an A Borrowed Chef account. From this Google account, A Borrowed Chef will collect the user's first and last name, profile picture, phone number, email address, and language preference. This information will be used only to set up the user’s account. Please refer to Google's Privacy Policy.

Facebook: users can use a Facebook account to create an A Borrowed Chef account. From this facebook account, A Borrowed Chef will collect the user's first and last name, profile picture, phone number, email address, and language preference. This information will be used only to set up the user’s account. Please refer to Facebook's Privacy Policy.

User Responsibilities:

You are solely responsible for safeguarding the confidentiality of your account credentials.

INTELLECTUAL PROPERTY

The content, trademarks, logos, and other intellectual property available on A Borrowed Chef are proprietary to A Borrowed Chef or its licensors. Unauthorized reproduction, dissemination, or use of this content is prohibited without prior written consent.

LIMITATION OF LIABILITY

To the maximum extent permissible under applicable law, A Borrowed Chef shall not be held liable for indirect, incidental, or consequential damages arising from your use or inability to use A Borrowed Chef. Such damages may include, but are not limited to, loss of data, operational disruptions, or reliance on A Borrowed Chef content.

THIRD PARTY SERVICES

A Borrowed Chef employs third-party services to facilitate operations, including but not limited to:

Google: if a user uses a Google account to create an A Borrowed Chef account, A Borrowed Chef will collect the first name, last name, email address, phone number, language preference, and profile picture associated with this Google account. Please refer to Google's Privacy Policy.

Facebook: if a user uses a Facebook account to create an A Borrowed Chef account, A Borrowed Chef will collect the first name, last name, email address, phone number, language preference, and profile picture associated with this Facebook account. Please refer to Facebook's Privacy Policy.

Twilio: When placing an order, users are prompted to enter their phone number. This phone number will be processed by Twilio in order to send a one-time confirmation SMS to users immediately after their order has been placed. Additionally, if you opt-in to receiving marketing-related update texts, your phone number will be processed by Twilio to securely send you an SMS regarding food offerings or event updates. Wix Payments: when paying for an order, A Borrowed Chef utilizes Wix Payments to securely process your payment using your billing address and credit/debit card information. We do not store this information or use this information for any other purpose. Please refer to Wix Payments' Privacy Policy.

CANCELLATION AND REFUND POLICY

Orders are non-cancellable and non-refundable through A Borrowed Chef upon confirmation, except where mandated by applicable laws. If you encounter an issue with your order, reach out to us through the Contact page.

AMENDMENT TO THE TERMS

A Borrowed Chef reserves the right to revise these Terms periodically. Any amendments will be published on this page with a revised effective date. Continued use of A Borrowed Chef post-amendment signifies your acceptance of the updated Terms.

GOVERNING JURISDICTION

These Terms are governed by the laws of Massachusetts. Any disputes arising from these Terms shall fall under the exclusive jurisdiction of the courts in Massachusetts.
